Evaluation Requirement

When lending the software (hereinafter referred to as "evaluation software") to a customer, it is conditional on the customer agreeing to each of the following terms and conditions.

1. The purpose of using the evaluation software set is limited to determining whether to purchase this software from Advanced Data Controls Corp.
2. We will not use the product produced with the evaluation software set except for evaluation purpose.
3. We will not use the evaluation software set outside the country of purchase.
4. The evaluation software used by the Customer and the computer system on which the evaluation software operates (hereinafter referred to as "Designated System") are limited to the evaluation software and Designated System for which the Customer has applied for evaluation loan.
5. The Customer shall not allow a third party to use the evaluation software, nor shall the Customer make copies of the evaluation software. The Customer is obligated to manage the evaluation software so that the copyright of the evaluation software is not infringed.
6. The Customer shall report information and evaluation results of the evaluation software to TAIYO YUDEN in the format specified by TAIYO YUDEN [ Evaluation Report ]. We will not disclose the content reported by the Customer to any third party except for the developer of the evaluation software and the developer of the processor targeted by the evaluation software.
7. Upon completion of the evaluation or at the end of the evaluation period, the customer erases all evaluation software on the designated system and destroys the installation media (CD-R) and all accompanying documents. If you fail to do so, you will purchase the evaluation software from us.
8. You shall be responsible for all damages caused to us by your failure to comply with each item of these terms and conditions.
